Binding arbitration. Except for the carve-outs below, any dispute, claim, or controversy arising out of or relating to this Agreement, the website, the SMS program, or any interaction with Clawsers LLC (“Dispute”) will be resolved by final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules (available at jamsadr.com). The arbitration will take place in Los Angeles County, California, or by video conference at your election; the arbitrator may award the same individual relief a court could award. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. You and Clawsers LLC each agree that any Dispute will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, mass, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and proceed in court; the remaining claims shall still be arbitrated.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to oleg@asizhomes.com within 30 days of first accepting this Agreement. The notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provisions of this Agreement.
Carve-outs. Either party may bring an individual action in small-claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights. Any court action not subject to arbitration shall be filed exclusively in the state or federal courts located in Los Angeles County, California, and each party consents to the personal jurisdiction and venue of those courts.
Jury trial waiver. To the maximum extent permitted by law, each party waives any right to a trial by jury in any proceeding arising out of or relating to this Agreement.
Limitations period. Any claim arising out of or relating to this Agreement or the service must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
Assignment. You may not assign any of your rights or obligations under this Agreement without our prior written consent.
Severability. If any provision of this Agreement is found unlawful or unenforceable, it shall be reformed or severed, and the remainder of the Agreement shall remain in full force.
Connectivity charges. You are responsible for any third-party connectivity charges your use incurs, including fees related to text messaging and data.
Termination. Clawsers LLC may terminate or suspend your use of the website for any reason. Upon termination, all rights granted to you will revert to Clawsers LLC.
